Project Overview and Role:

Palladium was awarded the USAID/Trade Reform and Development in Egypt (TRADE) Activity contract, which has a 5-year timeframe and a ceiling of $36.3 million. The goal of the TRADE Activity is to increase Egypt’s international trade by increasing exports from SMEs, and in particular New and Expanding Export-Ready Enterprises (NEEREs). This will be achieved by addressing the constraints that impede the competitiveness of Small and Medium-sized Enterprises (SMEs).

In order to achieve the Activity’s goal (increasing exports in selected sectors), Palladium must attain the following three Results:

Enhanced Export Capacity of SMEs, in particular New and Expanding Export-Ready Enterprises (NEEREs)in Selected Sectors

Strengthened Public and Private Trade-Support Institutions (e.g., Trade

Associations, Export Councils, etc.); and

Improved Trade and Investment Policy, Regulatory and Institutional Environment

Background on the assignment

The USAID TRADE Project is focused on enhancing trade and investment policies, as well as the regulatory and institutional framework, as outlined in result 3. This encompasses five key areas of focus. The second area aims to expedite and streamline the movement of goods across borders, aligning with the provisions of the WTO Trade Facilitation Agreement and international best practice.

Recently, GOEIC has made significant strides in its legislation concerning the implementation of the Integrated Risk Management System for overseeing the importation of both industrial and non-food consignments at Egyptian ports. This system is known as Risk-Based Inspection (RBI) that addresses imported product non-compliance risks. This progress is reflected in the issuance of two new ministerial decrees, namely Nos. 283 and 284. These decrees grant GOEIC the authority to apply Risk Management (RM) techniques.

Ministerial Decree No. 283 amended the export/import regulation established by Ministerial Decree No. 770 of 2005. This addition, Bis Article No. 94, empowers GOEIC to institute a risk management system specifically tailored to the inspection and testing procedures of imported non-food and industrial commodities. This ensures that these operations are conducted selectively based on established disciplines and rules for evaluating risk factors. On the other hand, the second ministerial decree, No. 284, is dedicated to forming a high committee tasked with defining the disciplines and rules for implementing a risk management system within GOEIC for the inspection of imported non-food and industrial goods, considering feedback from the related private sector’s stakeholders.

The overarching objective of TRADE’s support to GOEIC in this area is to expedite the release process and reduce associated costs for imported industrial goods and production supplies. To achieve this, the direct aim of this assignment is to support the formed GOEIC Technical Working Group in developing a science-based risk assessment matrix for the non-food & industrial consumer products (Textiles, Leather, and Furniture) listed in annexes No. (3) & (8) of the Executive Regulations of the Law No. 118 / 1975, issued by the Ministerial decree No. 770 / 2005 (Annex “1” is attached which includes all those product sectors). The consultant will help the GOEIC Technical Working Group to evaluate and develop a risk assessment matrix with risk levels for the aforementioned product sectors, conduct training & coaching for the TWG’s members on Risk Assessment according to a Training Needs Assessment to be developed for that purpose considering international best practices in this domain.

Primary Duties and Responsibilities

The consultant is required to perform the following tasks:

  • Use the terms of reference already developed for the electrical sector Technical Working Group to develop a similar document for the Textiles, Leathers and Furniture sectors Technical Working group (i.e., including objectives and functions of the working group, Standard Operating Procedures (SOPs) for conducting a consumer product risk assessment, setting a mechanism to classify the expected Product Risk, what Criteria to use, what roles/competencies are needed within the group, etc.)
  • Based on the Technical Working Group Terms of Reference (should be approved by GOEIC’s leadership) and previous training needs assessment developed for the electrical sector, the consultant will develop a training needs assessment report on the product sectors mentioned above for the TWG’s members.
  • Develop a science-based risk assessment procedure to evaluate, determine, classify and quantify the risks of consumer products for Textiles, Leathers, and Furniture listed in Annexes 3 and 8 of the Ministerial Decree No. 770 of 2005 which are about 1976 products as illustrated in the attached Annex 1, according to the well-recognized international guidelines and methods in this field.
  • Prepare a risk assessment matrix with risk levels for each product of the Textiles, Leathers, and Furniture sectors in the said list, taking into consideration relevant international regulations and any other literature to benefit from their methods followed in this regard, i.e., how to assess risk, and how that risk can be mitigated.
  • Conduct training & coaching according to the training needs assessment that should include the following:
  • Identification of the hazard that is intrinsic to each product of the listed products mentioned before.
  • The determination of the probabilities of the hazard occurring and severities of the respective consumer injuries scenarios that could take place by the intrinsic product hazard.
  • The combination of hazards with the probabilities in order to determine the overall risk for each product.
  • Develop a list of recommendations on the most effective and efficient business process to connect the Risk Management Database with the upcoming Electronic Risk-Based Inspection System (to be established by GOEIC)”.

Deliverables

  • GOEIC consumer product risk assessment matrix and procedures (per above).
  • TOR for the Technical Working Group (per above).
  • Training needs assessment report on each product category (per above)
  • Training & coaching programs on each product category according to the training needs assessment.
  • Brief consultancy report describing the purpose of the consultancy, details of activity implementation (main tasks delivered, progress achieved, lessons learned), observations, challenges encountered, detailed recommendations with the next steps.
  • PPT summarizing all tasks that have been implemented in this assignment to be presented by the consultant for public and private stakeholders.

Reporting: The Consultant will report to TRADE’s Senior Trade Facilitation Advisor

Period of Performance: TBD.

Level of Effort: The level of effort under this consultancy agreement is not to exceed 30 working days, including travel, preparation, report writing, and any needed follow up.

Payment Terms: Payment will be made on the basis of a fixed daily rate for actual time spent in completion of approved listed deliverables under the contract.

Required Qualifications:

Qualifications

  • At least fifteen years’ experience, with specific (broad and deep) knowledge, in formulating and implementing science-based risk assessment for non-food & industrial consumer products, preferably for Textiles, Leathers and Furniture sectors, according to international best practices in this domain. 
  • Have a good history, previous work, and consultancy in applying internationally recognized standard guidelines of risk assessment for non-food & industrial consumer products, preferably for Textiles, Leathers and Furniture sectors.
  • Should be acquainted with and practiced with recognized electronic risk assessment tools and database systems for identifying and classifying non-food consumer products.
  • To be knowledgeable about the international Harmonized System (HS) codes of classifying merchandised products of non-food consumer products being used in the cross-border trade.
  • Should have high proficiency in English/ Arabic language is preferable.
