Background

The Independent Medical Legal Unit (IMLU) is a governance, health, and human rights nongovernmental organization. IMLU advocates for justice, healing, and accountability for victims of torture, driven by a commitment to upholding human rights and promoting a society free from torture. Over the last three decades, the organization has supported more than 6,000 victims of torture, cruel, inhuman, and degrading treatment. IMLU has a national presence of over 300 professionals: doctors, trauma counsellors, lawyers, human rights monitors, and journalists.

Introduction

IMLU over the years as one of the key pillars of its mandate, has advocated for political, legal, and institutional reforms. IMLU is keen on pushing for key legal reforms, especially those that promote, enhance, and strengthen the protection of human rights and prevent torture, ensure justice, healing, and accountability.

As part of IMLU’s strategic plan to support the reform agenda and development of social capital and nurturing strategic alliances, IMLU established a strategic partnership with the National Police Service to support efforts aimed at promoting the transformation of the Service. One of these areas of partnership is in the establishment of Community Policing Committees at the national, county, and ward levels.

In the last year, IMLU supported the establishment and training of community policing committee (CPC) members at three police stations in the western region (Busia, Kakamega, and Vihiga counties). These structures are instrumental in promoting cohesion between the community members and the police officers, monitoring and reporting of sexual and gender-based violence, and promoting safe and secure spaces where community members can thrive among other benefits.

IMLU further equipped the three police stations with gender desks, trained police officers on sexual and gender-based violence, and sensitized community members on SGBV through radio talk shows. Additionally, victims of sexual and gender-based violence were supported to access comprehensive medical and psychological services and offered legal representation.

Scope of Work

IMLU seeks to engage a qualified consultant to conduct an endline evaluation of the project “Increasing Police and Citizen Capacities to Address Sexual Gender Based Violence in 3 Police Stations in Kenya”. This project was implemented in Vihiga, Busia, and Kakamega counties. The endline evaluation aims to assess the outcome of the community policing committees and the gender desks. The consultant, therefore, will be expected to conduct field visits in the target counties and gather data from relevant stakeholders to harvest project outcomes and lessons learnt during the implementation period. The consultant will also review relevant documents including the baseline reports and project documents to gather enough background upon which the evaluation will be conducted.

Intended Outcome

The intended outcome of this endline evaluation is to assess the relevance, effectiveness, efficiency, impact, and sustainability of the project initiatives. Further, the evaluation should document the broad programming challenges/gaps, lessons for broader organizational learning, and recommendations drawn during the implementation period for consideration in future programming. The evaluation should not only assess how well the initiative has performed but also seeks to answer the ‘why ‘question by identifying factors contributing to (or inhibiting) the successful delivery of the results. The evaluation should compare with baseline conditions and assess change.

Key Deliverables

The following are key deliverables for the consultancy:

  • Develop an inception report with a detailed execution plan for conducting the endline evaluation. The inception report is to detail the methodology, data collection tools, and a clear work plan for the exercise.
  • Final evaluation report detailing the findings of the project based on OECD/DAC evaluation criteria and/or any other appropriate methodology. This report should include challenges, recommendations, and lessons learnt for adoption in future programming.
  • At least three impact stories Timelines The consultancy is expected to take fourteen working days from the date of contract execution.

Qualifications

The consultant should have expertise in community policing, law enforcement, conflict resolution, or community engagement and provide sample reports of similar consultancies conducted. Consultants with the following key qualifications and competencies are highly encouraged to apply:

i. Functional Competencies

The applicant(s) in the consultancy firm should possess the following:

  • Expert knowledge of human rights, legal framework, health, and the law.
  • Experience in conducting evaluations for human rights, democracy, governance, and policy reforms assignments.
  • Experience in the legal framework for CPCs and bottlenecks in the implementation of CPCs will be an added advantage
  • Ability to research and write at a high level
  • Ability to research and conduct interviews with key informants; and
  • Experience in the use of mobile data collection, data analysis, and data visualization softwares.

ii. Core Competencies:

  • Ability to produce high-quality outputs in a timely manner while understanding and anticipating evolving client needs.
  • Strong organizational skills
  • Ability to work independently, and produce high-quality outputs
  • Sound judgment, strategic thinking, and the ability to manage competing priorities
  • Demonstrates integrity by modeling IMLU’s values

  • Fulfills all obligations to gender sensitivity and zero tolerance to sexual harassment.

iii. Education

  • The lead consultant should have a minimum of a master’s degree in law, statistics, gender, or other relevant social sciences.
  • Minimum of 5 years’ demonstratable experience in research, conducting similar evaluations.

The consultant/firm must have a demonstrated consultancy track record and be recognized as a seasoned professional with a high degree of professionalism, proficiency, and extensive experience in the field of human rights. The consultant /firm will also be required to adhere to IMLU’s safeguarding policy.

Submission of Bids

IMLU invites interested service providers to submit the following documents (Not exceeding 6 pages).

  • A technical proposal, work plan, and evaluation matrix, including a commitment to be available for the entire assignment period.
  • A detailed financial proposal (Attached as an annex)
  • Updated resume that clearly spells out qualifications and experience for the key Consultant(s). (Annexed, and are not part of the statement of expression of interest)
  • Reference organizations that have recently (preferably in the last 3 years) contracted the firm/consultant(s) to carry out relevant research/survey or related work.
  • The consultant/ firm must be registered under recognized professional bodies and within the laws of Kenya.
  • Sample reports of similar work done in the last five years with international nongovernmental organizations.

Evaluation Criteria

The evaluation committee shall evaluate the proposals based on their responsiveness to the Terms of Reference, through the following stages:

  • Preliminary evaluation
  • Technical evaluation
  • Financial evaluation

Preliminary evaluation

The following shall form the basis for preliminary evaluation. Interested bidders MUST attach the following.

  • Certificate of registration from a recognized professional body/ incorporation (applicable to consultancy firms).
  • Copy of VAT/PIN certificate from KRA.
  • Valid Tax compliance certificate
  • Should be a firm/individual consultant with office/operational establishments within Kenya.

Technical evaluation. The evaluation committee shall evaluate the proposals based on their responsiveness to the Terms of Reference, with keen interest in the following:

1. Experience in conducting similar services within the last five years. Attach contracts, purchase orders, LPOs, recommendations, etc. 20 points ***(*At least four proof of previous work experience attached)

Demonstratable consultancy experience working in similar assessments with CSOs focus on Human rights, governance advocacy, and reforms. 10 points

Maximum points 30

2. The lead consultant must have a minimum of 5 years’ experience in conducting evaluations, development of strategic plans, Outcome harvesting, etc. with international NGOs preferably with a broad understanding of human rights issues, governance, political and economic dynamics, gender, and community development. 20 points

The lead consultant/applicant must have a master’s degree in either law, statistics, governance, gender, communication, or other social sciences. (Attach academic certification and CV) 10 points

Maximum points 30

3. Adequacy of methodology in responding to the terms of reference and Proposed Work-plan. (20 points will be awarded for an adequate methodology and 10 points for an adequate work plan)

4. Attach at least two samples of similar work done, preferably for an international non-governmental organization with programming around human rights, governance, and policy reforms, etc. will be an added advantage. Maximum points 10

Each responsive proposal will be given a technical score. A proposal shall be rejected at this stage if it does not respond to important aspects of the Terms of Reference or if it fails to achieve the minimum technical score of 70%.

Financial evaluation

Bids determined to be substantially responsive to the requirements of the terms of reference shall be subjected to price comparison.
